
Kaplan's Win $10K College Scholarship Sweepstakes 2006 Official Rules
1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED, TAXED, OR OTHERWISE RESTRICTED BY LAW.
2. SWEEPSTAKES PERIOD AND ENTRY DEADLINES: Kaplan's Win $10K College Scholarship Sweepstakes ("Sweepstakes") begins at 6:59 A.M. EST on Wednesday, August 9, 2006, and ends at 11:59 P.M. EST on Tuesday, October 31, 2006 ("Sweepstakes Period"). Completed official entry forms must be deposited at a participating Kaplan center or, if available, Kaplan on-campus site or other third-party Sweepstakes entry location, by closing time on October 31, 2006. Visit the Kaplan website at kaptest.com for a list of participating centers and entry locations. All mail-in entries (completed official entry forms and postcards) must be postmarked by Tuesday, October 31, 2006. Online entries must be sent electronically by 11:59 P.M. EST on Tuesday, October 31, 2006. All entries must be received by Wednesday, November 15, 2006, regardless of method of entry.
3. ELIGIBILITY: This Sweepstakes is open to legal residents of the 50 United States and the District of Columbia and Canada (excluding the Province of Quebec) ("Eligible Jurisdictions") who are thirteen (13) years of age or older and enrolled at the time of entry as a full time high school freshman, sophomores, or juniors in an Eligible Jurisdiction. Entrants must be present in one of the Eligible Jurisdictions at the time that they enter the Sweepstakes. In order to be eligible to claim the prize, the entrant selected as winner cannot have already graduated high school at the time of prize notification and may be required to submit proof of eligibility, as requested by Sponsor. Officers, directors, representatives, and employees of Kaplan, Inc. ("Sponsor"), its parent, affiliates or subsidiaries ("Sponsor and its agents"), and their immediate family and household members are not eligible to enter or win.
4. TO ENTER: You may enter the Sweepstakes any one (1) of the following three (3) ways. Simply pick up an official entry form at any participating Kaplan on-campus site, Kaplan center in the United States or Canada, or other third-party Sweepstakes entry location during the Sweepstakes Period, while supplies last, and either (a) drop off the completed entry form at a Kaplan on-campus site (if available) or Kaplan center; or (b) mail your completed entry form with first class postage to: Kaplan Test Prep and Admissions, Kaplan Win $10K Sweepstakes, 1440 Broadway, 9th Floor, New York, New York 10018.
You may also enter by visiting the Kaplan website at kaptest.com/win10k and following the instructions to complete and submit an official entry form. As part of your entry, you will be asked to provide your first and last name, email address, permanent address and phone number, parent's first and last name, parent's email (if available), date of birth, the name of the high school you are currently attending, the month and year that you will graduate from high school, and the date(s) you plan to take the PSAT, and/or SAT and/or ACT (including month and year). You may also enter by hand-printing on a 3" x 5" postcard all of the information listed above and mailing the postcard with first class postage affixed to: Kaplan Test Prep and Admissions, Kaplan Win 10K Sweepstakes, 1440 Broadway, 9th Floor, New York, New York 10018.
LIMIT ONE ENTRY PER PERSON AND/OR EMAIL ADDRESS. Multiple entries will be disqualified. Entries are void if they contain typographical, printing or other errors. Entries generated by a script, macro or other automated means are void. Entries that are late, mutilated, altered, incomplete, mechanically reproduced, tampered with, illegible, inaccurate, forged, postage due, irregular in any way, or otherwise not in compliance with these Official Rules are also void. All entries become the property of the Sponsor and will not be returned to the entrant. Sponsor and its agents will not be responsible for lost, late, illegible, incomplete, misdirected or damaged entries, or other mail or email, or for internet, network, computer hardware and software, phone or other technical errors, malfunctions and delays that may occur or any other technical problems related to website entries. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed to have been submitted by the authorized account holder of the email account from which the entry is made. The authorized account holder is the natural person to whom an email address is assigned by an internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address.
By entering or accepting a prize in this Sweepstakes, entrants agree to (i) be bound by the decisions of the judges, the Sponsor and these Official Rules; (ii) to comply with all applicable federal, state and local laws and regulations and (iii) to be contacted by Sponsor by email, mail and/or telephone.
5. WINNER SELECTION: One (1) grand prize winner will be selected from all eligible entries received in a random drawing to be held on or about Tuesday, January 9, 2007. The drawing will be conducted by an independent judge, whose decisions shall be final and binding in all regards. Entrants need not be present to win.
6. WINNER NOTIFICATION AND VALIDATION: The winner of the drawing will be notified by mail approximately 10 days after the drawing and may be required to sign, and have his or her parent or legal guardian sign, an Affidavit of Eligibility and Compliance with these Official Rules and a Liability and (unless prohibited) Publicity Release ("Affidavit and Release") and returned to Sponsor within fourteen (14) days after the date on the prize notification. If the potential winner is a minor, the minor's parent or legal guardian will be responsible for signing any necessary releases, consents, and affidavits. If the potential winner is a Canadian resident, he or she will have to answer correctly a mathematical skill-testing question on the Affidavit and Release in order to be declared a winner. Failure of the potential winner and his or her parent or legal guardian to complete, sign and return any requested documents as directed, or to answer correctly the mathematical skill-testing question if applicable, or the return of any prize notification or prize as undeliverable may result in disqualification and selection of an alternate winner in Sponsor's sole discretion. You are not a winner unless and until your submissions are validated.
7. PRIZES: One (1) grand prize will be awarded. The grand prize will be $10,000 USD for winner's college tuition expenses, awarded in the form of a check made payable to the winner and a free Kaplan Classroom SAT, ACT, or PSAT course of the winner's choice. Approximate retail value of prize: $10,699 USD to $10,999 USD depending on the course selected by winner. Odds of winning depend on the number of eligible entries received. Prize claimed in accordance with these Official Rules will be awarded. All federal, state, and local taxes are each winner's sole responsibility. To minimize the tax burden, winner, if a U.S. resident, must submit a college tuition bill to Sponsor before December 31, 2007. Otherwise, Sponsor must report prize as taxable income and will issue a 1099 tax form to winner for the value of the prize. If a U.S. resident, the winner also has the option to delay receipt of payment until the year the winner enters college. For example, if the winner delays acceptance of payment until 2008, and submits a college tuition receipt to Sponsor before December 31, 2008, in the amount of $10,000 or more, Sponsor may treat this prize as a scholarship and does not need to issue a 1099 tax form to winner. A 1099 tax form will be issued to winner, however for the value of the free SAT or ACT prep course if winner accept that portion of the prize. The prize may not be transferred. No prize substitution allowed, except Sponsor reserves the right in its sole discretion to substitute any prize with a prize of comparable value. In the event that a winner chooses not to accept his or her prize, does not respond to prize notification within 14 days, or does not complete, sign and return any requested documents as directed, the prize will be deemed forfeited, and sponsor may, in its sole discretion, award the prize to an alternate winner.
8. GENERAL CONDITIONS: By entering the Sweepstakes or accepting a Sweepstakes prize, entrants accept all the conditions, restrictions, requirements and/or regulations required by the Sponsor in connection with the Sweepstakes, including without limitation, these Official Rules. Acceptance of aprize constitutes permission to use winner's name, picture, likeness, address (city and state), and biographical information for advertising and publicity purposes in all media worldwide, without prior approval or compensation, except if winner is a resident of Tennessee or otherwise where prohibited by law. Acceptance of a prize constitutes a waiver of any claim to royalties, rights or remuneration for that use. Each entrant agrees to release and hold harmless the Sponsor and its agents, successors and assigns from any and all claims, damages, injury, death, loss, or other liability that may arise from entrant's participation in the Sweepstakes or, if a winner, the awarding, acceptance, possession, use, or misuse of the prize. Sponsor reserves the right in its sole discretion to modify, suspend or cancel all or any portions of the Sweepstakes because of technical errors or malfunctions, viruses, hackers, or for other reasons beyond Sponsor's control that impair or corrupt the Sweepstakes in any manner. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment or corruption and/or through uncorrupt methods of entry. Sponsor also reserves the right in its sole discretion to disqualify any entrant who fails to comply with these Official Rules, who attempts to enter the Sweepstakes in any manner or through any means other than as described in these Official Rules, or who attempts to disrupt the Sweepstakes or the kaptest.com website or to otherwise circumvent any of these Official Rules. This Sweepstakes is governed by the laws of New York, with venue in New York County. New York. All claims must be resolved in the state or federal courts of New York County, New York.
9. WINNERS' LIST: Starting approximately February 1, 2007, a winners' list may be obtained by sending a self-addressed stamped envelope to: Kaplan's College Search Sweepstakes Winners' List, Kaplan, Inc., Marketing Department, 1440 Broadway, 9th Floor, New York, New York 10018. All winners' list requests must be received by April 30, 2007.
10. USE OF ENTRANT AND WINNER INFORMATION: The information that you provide in connection with the Sweepstakes may be used by Sponsor to send you information about its products and services. If you would like your information removed from Sponsor's mailing list or if you do not wish to receive information from Sponsor or if you would like to be removed from Sponsor's mailings regarding sweepstakes, write to Sponsor at Kaplan, Inc., Marketing Department, 1440 Broadway, 9th Floor, New York, New York 10018. Sponsor will process your request within 60 days.
